The IT Rules Amendment, 2026 marks a major shift in India’s digital ecosystem by directly tackling deepfakes, AI-driven misinformation, and impersonation. Strengthening the due diligence framework under Rule 3, all intermediaries must take steps towards preventing any hosting of unlawful content. Another major change introduced is strict takedown timelines, whereby the intermediaries will have to take down unlawful content within a timeframe of hours, at times just 2-3 hours in sensitive cases. This emphasis on speed reflects how quickly harm can spread online, making delayed action almost ineffective in today’s digital landscape. In addition to this, the amendment introduces clear obligations concerning AI-generated content: where content is significantly created or altered using AI and appears realistic, it must be clearly labelled, supported by embedded metadata. This makes transparency non-negotiable for creators, turning AI use from a hidden tool into a compliance requirement. Platforms have long relied on safe harbour under Section 79 of the Information Technology Act, 2000, protecting them from liability for user content. The 2026 amendment tightens this by linking protection to strict compliance with Rule 3, including rapid takedowns and AI labelling. Failure to comply can lead to loss of immunity, making platforms directly liable. This leads platforms to adopt tighter moderation practices and a risk-averse approach, which can sometimes limit creative expression.
